Jail, cane for illegal entry

Kota Kinabalu: Two illegal immigrants were jailed four months and ordered given a stroke of the cane each for entering the State without any identification document.Mohd Musa Apsal and Razz Salam pleaded guilty separately before High Court Deputy Registrar Dana Arabi Wazani who sat as Sessions Court Judge.

The illegal immigrants were arrested at different locations, in Telipok and Sepanggar, by the police after failing to produce valid documents.
The offence under Section 6(1)(c) of the Immigration Act 1959/1963 provides for a a jail term of up to five years, or a fine of up to RM100,000, and whipping, on conviction.
After serving their jail sentence, the court ordered the foreigners referred to the Immigration Department for deportation.
Meanwhile in the Magistrate’s Court, the foreigners were also charged separately with committing different offences.

They were brought before Magistrate Lovely Natasha Charles to face the charge against them, respectively.
Mohd Musa claimed trial to threatening one Kola Jailadi, an IMM13 holder, by causing fear to the latter at 11am on Jan 28 this year at the Telipok Settlement.

The court set May 14 for case management and no bail was offered to Mohd Musa.

His case management was set for May 20 and the court ordered Razz remanded further.
