KK trio fined for defying MCO
Kota Kinabalu: Three men were penalised by the Magistrate’s Court, Thursday, for defying the Movement Control Order (MCO) in April.

Robinson Dominic, 25, Jason Robert, 28, and Gutirrez Edward, 33, pleaded guilty separately to committing the offence on April 16 during the phase three of the MCO.

They appeared separately before Magistrates Lovely Natasha Charles, Jessica Ombou Kakayun and Stephanie Sherron Abbie.

Robinson was fined RM1, 000 or three days for moving from Mile 5 Penampang to HSK Industrial Park, Penampang at 9.05pm.

He claimed that he wanted to buy a phone reload at that time.

Jason was fined RM800 or two weeks jail for moving from Kg Ramayah, Penampang and was arrested by police at the roadside of Jalan Kg Dabak after meeting his friend in Penampang, the court heard.

Gutirrez was fined RM700 or one month’s jail for travelling with a friend from Delta Height Jalan Bundusan, Penampang to the Bataras supermarket in Bundusan at 3.10pm.

At that time only one person was allowed to travel in a car.

Robinson and Jason violated Rule 3(1) of the Prevention and Control of Infectious Diseases (Measures Within The Infected Local Areas) Regulations 2020 while Gutirrez violated Rule 4(1)(a)(ii) of the same Regulations.

The offences are punishable under Rule 11(1) of the same Regulations that carries a fine of up to RM1,000 or a jail term of not more than six months or both,  upon conviction.

The three, who were unrepresented, requested a lenient sentence while Deputy Public Prosecutor (DPP) Siti Hajar Mazlan pressed for a deterrent sentence in all cases.
