Murder of convict by 10 prison staff for High Court
The accused on their way to the lock-up.
Kota Kinabalu: The case of 10 prison personnel charged with murdering an inmate at Kepayan Prison has been transferred to the High Court.

Magistrate Afiq Agoes on Tuesday made the order following an application by the prosecution.

Senior Federal Counsel Khairul Anuar informed the court that a sanction to transfer the case to the High Court for the charge under Section 302 of the Penal Code had been obtained.

The 10 accused comprised prison inspector Dzulfikri Mohd Safri, 28, and wardens Barry Jipmon, 30, Farizan Mokri, 40, Mohd Saiful Saidin, 34, Amran Yasik, 25, Ab Mutalib @ Talib Abd Rasul, 40, Zerry Maidin, 33, Tomy Momoh, 36, Shahryll Nazry Wan Sofian, 25, and Muhammad Fazi Lakui, 32.

They were all jointly accused of murdering one Shainal Mukhtar, 36, in a cell of Gemilang Block, at Kota Kinabalu Central Prison, Jalan Kepayan near here at 4.30pm, on Oct 4, 2019. Their plea will be recorded at the High Court.

The charge under Section 302 of the Penal Code carries the death penalty on conviction. The 10 were ordered to be remanded further as the charge against them has no provision for bail. Together with SFC Khairul was Deputy Public Prosecutor Mohd Khairuddin Idris. Counsel Hairul V. Othman and Dominic Chew appeared for the accused on Tuesday. In another case, a man was fined RM5,000 or 24 months jail for having 5.63gm of ketamine. Johnson Wong pleaded guilty before Magistrate Jessica Ombou Kakayun to having the drugs at 4pm on May 28 in Penampang. Inspector Albert Basiri prosecuted.
