Jail and cane for robbing disabled boy of handphone

Kota Kinabalu: A 36-year-old man who robbed a 16-year-old disabled boy of his handphone, was sentenced to eight years’ jail and a stroke of the cane.Sessions Court Judge Noor Hafizah Mohd Salim handed the sentence to Sofian Karim who changed his plea and admitted to the charge against him during submissions from both parties, on Tuesday.ADVERTISEMENT
Tuesday was meant for submission from the prosecution and defence after the prosecution called four witnesses in the hearing.
Sofian robbed the boy of his handphone worth RM300 at 3pm on Nov 2, 2019 under a bridge in Papar.
The offence under Section 392 of the Penal Code carries a jail term of up to 14 years, and whipping, on conviction.
Sofian was ordered to serve the jail sentence from the date of his arrest on Dec 14, 2019.ADVERTISEMENT
During mitigation, Sofian who was not represented asked for a lenient sentence.
However, Deputy Public Prosecutor Megat Mahathir Megat Tharih Afendi urged the court to impose a deterrent sentence on the grounds that Sofian did not admit to the charge at the first instant but only after the prosecution called four witnesses.

He added that the victim was a minor who is also a disabled.
Meanwhile, a man was jailed three months for illegal entry.
Limpang Razak was also ordered a stroke of the cane after he pleaded guilty before Sessions Court Judge Azreena Aziz, to entering the State without any document.

After serving his jail sentence, Limpang was ordered referred to the Immigration Department for deportation.
