Habitual addict gets five years and rotan

Kota Kinabalu: A 46-year-old man who took drugs for the third time was sentenced to five years and ordered given a stroke of the cane.

Sessions Court Judge Elsie Primus meted out the sentence on Abdillah Batin who pleaded guilty to the charge against him on Wednesday.

He was found taking the drug at 11am on Dec 21, 2020 after his urine was tested positive at the Kota Marudu police station.

Investigation revealed that Abdillah has two previous convictions for taking drugs.

The offence under Section 15(1)(a) of the Dangerous Drugs Act 1952 and punishable under Section 39C(1) of the same Act which provides for a jail term of between five and seven years, and whipping, upon conviction.

During mitigation, Abdillah asked for leniency.

However, Deputy Public Prosecutor Mas Izzaty Lokman urged the court to impose a deterrent on the grounds that Abdillah had repeatedly took the drug. 

The court ordered Abdillah to serve the jail sentence from the date of his arrest on Dec 21, 2020.

After completing his jail sentence, the court ordered Abdillah to be placed under police supervision for three years.
