Vape distributor fined RM2,000

Kota Kinabalu: A vape distributor company was fined RM2,000 for having for sale eight types of liquid for electronic cigarette (vape) containing poison without licence.

Sessions Court Judge Ummu Khaltom Abd Samad handed down the sentence to Vape Empire Distribution Sdn Bhd after its representative pleaded guilty to the charge

The company was found selling the liquids namely five bottles of Bangsawan Mango Grape 65ml, three bottles Bangsawan Strawberry Apple 65ml, four bottles of Feel Fresh Apple Aloevera 55ml, six boxes of Milky Moo Milk Chiller 60ml, a box of Yolo Ice the Vaping Mint 60ml, two boxes of Yolo the Vaping Mint 60ml, five bottles of Vapempire Brew Ice Lemonade 60ml, and seven bottles of Civet Elegante Orange Cream Dew Melon Coconut.

All the liquids containing poison which was nicotine.

The offence took place at 3pm on Jan 29, 2018 at the Vape Empire Distribution Sdn Bhd in Ground Floor, Wisma Sabah, Jalan Tun Razak, here.

The offence under Section 13 (a) of the Poisons Act 1952 and punishable under Section 32(2) of the same Act which provides for a fine of RM3,000, or a jail term of  up to a year, or both, on conviction.

During mitigation, counsel Dominic Chew who represented the company, asked for lenient sentence saying that it was the company’s first offence.

However, Prosecuting Officer Lee Pin Wai from the Pharmacy Department urged the court to impose an appropriate sentence on the grounds that the eight products containing nicotine in which was only supplied by pharmacies or prescribed by doctors but the company was not a medical practitioner.

Lee said the nicotine content in vape can lead to addiction which is a type of chronic brain disorder.

He added that the use of nicotine liquid in vape is also seen to be a trend to underage students in Malaysia.

As a warning and deter others from committing such offence, an appropriate sentence should be imposed on the company, said Lee.
