Rioting at centre: Filipino gets 13 years’ jail

Kota Kinabalu: A 23-year-old Filipino, who rioted at the Immigration Temporary Detention Centre in Manggatal, together with several fellow inmates, was sentenced to 13 months’ jail.

Mazlan Abdul Razak admitted before Magistrate Lovely Natasha Charles to jointly committing the offence together with 20 other inmates at the centre at  Jalan Kokol Poring-Poring, Manggatal at 6.25am on Sept 10.

Mazlan was charged under Section 147 of the Penal Code read together with Section 34 of the Criminal Procedure Code which carries a jail term of up to two years or fine or both, on conviction.

The other 15 foreigners were sentenced to 13 months jail each on Nov 11 after pleading guilty

Inspector Kelvan Elson Maik, prosecuting, informed the court that an immigration officer lodged a police report at 11.53am on Sept 10 that detainees at the centre had rioted between 6.20am and 7.10am.

The court heard that officers on duty tried to control the situation by calming the female detainees in Block H and I from outside the gate but the detainees ignored and shouted “Usir…Usir...Usir (Evict...Evict...Evict)” and at the same time knocking on the wall of their block with food containers and water bottles.

Residents of blocks A, B, D, E, F, J, K, and N also joined in the riot by breaking out of their respective cells and also chanted “Usir...Usir...Usir” and also knocking on the walls of their block with food containers and water bottles, said the prosecution.

Investigations revealed found that a total of 21 people were identified as rioters by Immigration staff at the control post of the blocks involved, the court heard.

Witnesses’ statements supported the rioters’ actions which demonstrated criminal violence by intimidating civil servants in carrying out their official duties by opposing law enforcement at Immigration Detention Centre, said the prosecution.

Unrepresented, Mazlan requested for leniency, saying that he had been detained since 2019, from the prison to the Immigration Detention Centre. adding that his family was waiting for him outside.

Kelvan applied for an adequate sentence.

Lovely ordered Mazlan to serve the sentence from the date of his arrest and to be referred to Immigration Department after serving his sentence.

Meanwhile, a 26-year-old man was charged with committing mischief by destroying a cable at a building here.

Azmin Ruhito pleaded not guilty to cutting the cooling tower cable using a wire cable cutter at the Cooling Tower division of the Umno building here at 5.20am on Oct 8.

He was accused of committing the offence along with an accomplice.

The charge under Section 431A of the Penal Code which carries a jail term of up to two years or fine or both, on conviction.

Kelvan in applying for a pre-trial case management (PTCM) objected bail as Azmin has no valid document.

The court set Jan 4 for PTCM and ordered Azmin be further remanded.
