Man jailed six months for beating wife
Saidun punched her face twice and kicked her, causing his wife, who suffered from heart problems, to faint, said the prosecution. 
Kota Kinabalu: A 43-year-old self-employed man was jailed six months, Friday, for beating his wife.

Mohd Saidun Abdul Razak pleaded guilty before Magistrate Lovely Natasha Charles to causing hurt to his wife, 43, in a house at Taman Mei Lok, Luyang at 2pm on Sept 15.

The court was informed by the prosecution that Saidun’s whole family underwent seven days of home quarantine due to being Covid-19 positive from Sept 13.

On Sept 15, Saidun went berserk as he was not satisfied with the treatment of his 17-year-old son when massaging his body.

According to the wife, the family was in the living room on the said day when Saidun asked his son to massage his body.

However, Saidun was not satisfied with the strength of his son’s hands and thought his son was not sincere in massaging him and punched the son’s face.

The wife was shocked by the incident and stared at Saidun who then rushed towards her as he thought she was trying to hit him.

Saidun punched her face twice and kicked her, causing his wife, who suffered from heart problems, to faint, said the prosecution. The wife, who sustained injuries on her face, then lodged a police report against Saidun.

Unrepresented, Saidun requested a lenient sentence by saying that he was remorseful and that he gave cooperation during the investigations.

Saidun then asked to be jailed as he had no money to pay the fine and that no one will help him.

Inspector Kelvan Elson Maik applied for an adequate sentence.

Saidun was charged under Section 323 of the Penal Code read together with Section 326A of the same Code.

Section 323 carries a jail term of up to one year or a fine of up to RM2,000 or both on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to on conviction for that offence.

In another case, three people were jailed six months each for taking syabu.

Loius Gaspar, Julamri Kannang and Mcveron Lee pleaded guilty separately to committing the offence at different locations here and in Penampang between July 3 and Aug 18.

Taking drugs under Section 15(1) of the Dangerous Drugs Act provides for a fine of up to RM5,000 or up to two years jail, on conviction.
