Sabah Law Society execs seek costs over summons
Both Dak Wah and James were not known to have been physically served with the summons, apart from learning about its filing and its subsequent posting in a lawyers’ chat group. 
Kota Kinabalu: At least two people named in a summons over the publication of the names of 13 Sabah lawyers who had either been suspended from practising or struck off the roll, have decided to have it dismissed with costs.

It was based on a report “Action On 13 Sabah Lawyers” which appeared in the Daily Express on Feb. 19, 2024.

Former Sabah Law Society President Datuk Roger Chin and successor Mohd Nazim Maduarin have been named along with former Chief Justice of Sabah and Sarawak Tan Sri David Wong Dak Wah and Daily Express Chief Editor James Sarda in a writ of summons by lawyer Marcel Jude.

“We have moved to have the summons dismissed. I will ask for costs,” Chin said, confirming that the lawyer who had filed the action was, indeed, suspended.

“A search with the Office of the Insolvency Department would display his bankruptcy status,” he said.
