Woman who broke ATM screen in rage fined

Kota Kinabalu: A 42-year-old woman, who broke the screen of an ATM in a bank here last year was slapped with a fine of RM4,000 or 13 months jail.

Hildah Luguh pleaded guilty before Magistrate Lovely Natasha Charles on Thursday to committing mischief by banging the ATM’s screen using a trash can lid at a Maybank branch in Alamesra at 12.35pm on Dec 21, last year.

Inspector Kelvan Elson Maik, prosecuting, informed the court that prior to the incident, Hildah entered the premises without taking turns outside and informed a bank officer that she wanted to open a savings account there.

The bank officer, who was also the complainant, gave Hildah a form to fill but Hildah crumpled the form and threw it towards the officer.

Hildah then asked where the ATM machine was.

After being shown to the self-service terminal (SST), Hildah went there by herself.

Two minutes later the bank officer heard a loud noise from the SST area and ran towards the area and saw customers running out.

The bank officer also saw Hildah hitting the ATM using the lid of the trash bin nearby.

The loss was estimated at about RM10,000, according to the complainant.

The court heard that Hildah was arrested by police at 2.15pm on the same day after a report was lodged against her.

Hildah, who was unrepresented, told the court that she was stressed at that time and hence the reason why she broke the ATM’s screen.

She applied for a fine and requested for a lower amount.  She also told the court that she wanted to pay the fine by instalment.

Hildah said that she missed her mother who was seriously ill and that she could not get in touch with her family members.

Hildah was charged under Section 427 of the Penal Code which carries a jail term of between one year and five years or fine or both on conviction.

Meanwhile, a man who was charged with assaulting another man, will go on trial on March 4-5.

Magistrate Stephanie Sherron Abbie set the date for Afdhal Khairi Abd Muar during mention to fix the hearing date on Thursday.

Afdhal in his 30s, was accused of causing hurt to the man at a premise on the 11th floor of a shopping complex here on Dec 11, 2018.

He was charged under Section 323 of the Penal Code carries a jail term of up to one year or fine of up to RM2,000 or both on conviction.

Afdhal was represented by counsel Sylyester Kuan.
