Guard jailed, fined for mishap that killed Tawau motorcyclist

TAWAU: A security guard was jailed 30 months and fined RM5,000 or another three months after pleading guilty to dangerous riding that resulted in the death of a farm supervisor last year.Sharizan Salim, 37, pleaded guilty before Magistrate Dzul Helmy Yunus to committing the offence at Jalan Merotai-Bombalai at 9.03 am on April 28, 2020 resulting in the death of Yogaruban Amaran, 26.

The accident involved a Modenas motorcycle ridden by Yogaruban and Sharizan’s Honda.
Sharizan was going from Telekom Jalan Apas to Merotai, while Yogaruban was heading from Ladang Sg Imam to Ladang Sime Darby, Merotai.
Yogaruban, who was heading to work, was entering the right lane while Sharizan was overtaking.
Sharizan could not stop in time and hit Yogaruban’s motorcycle, dragging it 17 meters.

The victim’s motorcycle suffered damage to the rear and front.
The accused was charged under Section 41 (1) of the Road Transport Act 1987 which provides for imprisonment of two to 10 years and a fine of between RM5,000 and RM20,000, if convicted.

Earlier, the accused appealed to the court for a lenient sentence as he had lost his job after the accident and had dependants, including a seven-year-old son.
Traffic Prosecuting Officer ASP Joan Lee, applied for a heavy sentence to teach the accused a lesson and also Yogaruban’s family was cut off from their source of income, which supported the victim’s younger brother who is still studying.
The mother of the deceased also failed to join him in Sabah after his death, added Lee.
In his judgment, the magistrate was satisfied with the accused’s voluntary confession and hoped he would heed the lesson.Stay up-to-date by following Daily Express’s Telegram channel.
