Man denies sexually assaulting niece, 17
Kota Kinabalu: A 33-year-old man was charged with committing physical sexual harassment against his niece.

The man pleaded not guilty before Sessions Court Judge Abu Bakar Manat, after the charge was read to him, Friday.

The proceeding was conducted via Zoom.

He is accused of committing the offence against the 17-year-old girl by hugging her and kissing her forehead at 1am on July 20 this year at the room of a house in Papar.

The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years, and whipping, on conviction.

Due to the relationship between the man and the alleged victim, there will be additional punishment under Section 16(2)(c) of the same Act which carries a jail term of up to five years, and whipping at least two strokes, on conviction.

The court fixed Aug 30 for pre-trial case management for handing over documents.

The man was released on a bail of RM10,000 with RM5,000 deposited in two local sureties and ordered to report to Menumbok police station once a month.

The court also ordered his international passport if any, to be impounded by the court until the disposal of his case and the man was warned not to tamper with the prosecution witnesses.

Earlier, Deputy Public Prosecutor Nureen Natasha Mohd Raffie who appeared for the prosecution objected to bail due to the relationship between the man and the alleged victim.

However, counsel Dato Seri Rakhbir Singh asked for bail to be granted, saying that the man was not staying in the same house with the girl.
