Syabu: Homestay operator freed

Kota Kinabalu: A 38-year-old homestay operator was freed by the Magistrate’s Court from a charge of having 12gm of syabu.

Mohd Nasrul Jainorahim (with cap) was on Friday discharged and acquitted after a full trial.

Magistrate Afiq Agoes in delivering his decision, agreed with the counsel that the prosecution’s technical failure in tendering the amended charge with the accurate weight of drugs possessed by the accused, was fatal to the case. Nasrul was accused of having the drugs at 1am on March 30, 2018, at a house in Kg Linau, Kota Belud, on March 30, 2018.

Nasrul was charged under Section 12 (2) of the Dangerous Drugs Act 1952, punishable under Section 39A (1) of the same Act and carries a jail term of between two years and five years and whipping between three and nine lashes, on conviction.

Inspector U’Kasyah Hashim prosecuted while Nasrul was represented by counsel Azhier Farhan Arisin.

In another case, a 24-year-old Filipina was charged with engaging in online gambling using a handphone.

Merlyn Amil Hamja was accused of committing the offence at 7.27pm on July 24 at Kg Keliangau, Manggatal.

However, no plea was taken from Merlyn, who appeared before Magistrate Stephanie Sherron Abbie, via video conferencing.

The court set Sept 8 for Merlyn’s plea be taken at open court and ordered her to be remanded further.

Inspector Suzie @ Stephanie Kupit objected bail on the grounds that Merlyn has no valid identification documents.

Merlyn was charged under Section 7(2) of the Common Gaming Houses Act 1953, which provides for a fine of up to RM5,000 or up to six months jail or both, on conviction.
