Acquittal of man is upheld
Kota Kinabalu: The High Court here upheld the acquittal of a 38-year-old man from two counts of causing hurt to a man and committing mischief to three vehicles.

Judicial Commissioner Amelati Parnell in delivering her ruling on Friday dismissed the prosecution’s appeal against the Magistrate’s Court’s decision in acquitting Donny Kok of the charges.

Amelati affirmed the lower court’s order.

On Nov 1, 2019, Donny was discharged and acquitted by the Magistrate’s Court from a charge of causing hurt to Sapri Yaakup by ramming him with his car between 1.30am and 2am on March 24, 2016 behind a fast food restaurant in Papar. The offence under Section 324 of the Penal Code carries a jail term of up to 10 years, or with fine, or with whipping, or with any two of such punishments, on conviction.

Donny was also freed from the second count of causing damages to three cars at the same place and time. Counsel Safrin Salleh represented Donny.
