Drugs: 80-year-old jailed 10 years; wife is discharged

TAWAU: An octogenarian foreigner was jailed 10 years for having 30.75gm of syabu.

Hashim Sahipa, 80, pleaded guilty before Sessions Court Judge Awang Kerisnada Awang Mahmud to committing the offence at 4pm on Dec 7, 2020 at a stilt house at Kg Batu, Semporna.

Hashim was jointly charged with his wife Roaina Ali, 70, who pleaded not guilty to the charge under Section 39A(2) of the Dangerous Drugs Act (DDA) 1952 which carries a life imprisonment or not less than five years jail and not less than 10 lashes of the cane, on conviction.

Hashim also told the court that the drug was his and has nothing to do with his wife. Roaina was discharged not amounting to an acquittal.

Deputy Public Prosecutor Mohd Suhaimi Suriana in tendering the facts of the case said the couple was arrested during a raid.

Hashim was at the kitchen during the raid and a handbag was also found on the kitchen floor which was found to contain 178 packets of crystalline substance suspected to be syabu.

The couple was originally charged with drug trafficking under Section 39B of the DDA before they were charged with an amended charge under Section 39A of the DDA.
