Trio jailed for having six fish caught with explosives

Kota Kinabalu: Another three foreigners were jailed 10 months each for having six fish caught using explosives.Pilnama Muhamad, 49, Marbin Aybin, 43, and Alawi Hairon Abubakar, 25, pleaded guilty before Sessions Court, Judge Elsie Primus.ADVERTISEMENT
The three were found of having the six fish caught using explosives at 11am on Aug 11 this year inside a pump boat at the Saracen bank area in Pulau Mengalun, here.
The offence under Section 26(1)(c) of the Fisheries Act 1985 and punishable under Section 25(b) of the same Act read with Section 34 of the Penal Code which carries a fine of up to RM20,000, or a jail term of up to two years, or both, on conviction.
The court ordered the trio to serve the jail sentence from the date of their arrest on Aug 11 this year and referred to the Immigration Department after serving their jail sentence.
During mitigation, the trio asked for leniency saying that they have families to look after and promised to not repeat the offence.ADVERTISEMENT
Prosecuting Officer William Apin from the Fisheries Department urged the court to impose a deterrent sentence considering the public interest and to deter the accused persons as well as public at large to commit the same offence.
Meanwhile, the court fixed Nov 23 this year for another accused Akmar Abdullah, 22, who was charged together with the trio, pending his welfare report.

Pending the date, Akmar was ordered remanded further.
On Tuesday, four foreigners were jailed 10 months each for committing similar offence and the court advised the four to tell Pulau Gaya residents not to catch fish using explosives.
