Selling non-certified item: Trader and firm get fine
TAWAU: A trader and his company were fined a total of RM16,000 for selling two units of walkie-talkie which was not certified by the Standards and Industrial Research Institute of Malaysia (Sirim).

Sessions Court Judge Awang Kerisnada Awang Mahmud meted out the sentence to Director Liau King Choi, 46, and his company Best Secure & Automotion Sdn Bhd, after pleading guilty to the charge.

Liau was fined RM8,000 or two months’ jail for selling the two units of walkie-talkie valued at RM680 without Sirim certification as required by the Communications and Multimedia (Technical Standards) Regulations 2000. His company was also ordered to pay a fine of RM8,000 in default of two months’ jail for committing similar offence at its premises in Kubota Square, Jalan Kubota, here at 11.30am on June 10, 2020.

The offence under Regulation 16(1)(b) of the Communication and Multimedia (Technical Standards) 2000 is punishable under Regulation 37 of the Communication and Multimedia Act which provides for a fine of up to RM100,000 or a jail term of up to six months, or both.

During mitigation, counsel Voo Vun Han who defended Liau and his company, requested no custodial sentence be imposed on his clients and also urged leniency by saying that the equipment was not for sale but for his own use.

However, Malaysian Communications and Multimedia Commission (MCMC) Prosecuting Officer, Nur Nazhzilah Mohammad Hashim urged the court to hand down an appropriate sentence so as to give lesson to Liau as the offence was serious.

She added that the communication equipment must be certified by Sirim if it was to be sold in order to prevent misuse and security.

According to Nur Nazhzilah, Liau admitted that the equipment was only for his own use but he had already sold it to the public and that there was a receipt for its sale.
