Criminal Breach of Trust: Sarawakian couple charged
The offence under Section 409/34 of the Penal Code carries a jail term of between two and 20 years, and with whipping, and liable to a fine, on conviction.
Kota Kinabalu: A Sarawakian couple was charged with five counts of committing criminal breach of trust (CBT) by misusing company money amounting to RM7,191.20 which allegedly was used to  pay a worker who had resigned from the company.

Yeo Kwang Seaun, 41, and his wife Alicia Lim Ai Hsia, 38, pleaded not guilty to all the charges against them before two Sessions Court Judges namely, Elsie Primus and Noor Hafizah Mohd Salim, respectively, on Thursday.

On the first to fourth counts, Yeo and Lim, as the directors of Syarikat Fucos Trading (Sabah) Sdn Bhd, allegedly committed CBT by misusing the company’s money which had been used to pay the salary of one Sazien Sudin who had resigned from the company in August 2018.

The charges stated that the money was for Sazien’s salary of RM1,000 each for September, October, November and December 2018.

On the fifth count, the couple is accused of committing CBT by misusing company’s money of RM3,191.20 for the same purpose.

The offences allegedly took place at the company’s office in 2018 and Feb 15, 2019.

The offence under Section 409/34 of the Penal Code carries a jail term of between two and 20 years, and with whipping, and liable to a fine, on conviction.

The court set Sept 26 and Oct 3, this year for pre-trial case management and released the couple on bail of RM1,000 in two immediate family as their sureties for each charge against them. The couple was also ordered to report to Sungai Maong police station in Kuching, Sarawak every second and fourth Thursday of the month.

Failure to furnish the bail, the couple would be detained under Section 259 of the Criminal Procedure of Code.

Deputy Public Prosecutor (DPP) Dacia Jane Romanus and DPP Mas Izzaty Lokman prosecuted the cases, respectively, while counsel Serena Liew defended the couple.
