84 years, 17 strokes for sexually abusing stepdaughter

Kota Kinabalu: A Filipino father of three was jailed a total of 84 years plus 17 strokes of the cane for five counts of committing various physical sexual harassment against his stepdaughter.The 39-year-old IMM13 holder pleaded guilty to all charges before three Sessions Court judges, namely Azreena Aziz, Amir Shah Amir Hassan and Ummu Kalthom Abd Samad.

For the five charges, he was jailed 14, 13, 15, 15 and 13 years, respectively and seven strokes of the cane.
The three judges also imposed additional jail sentences of three, two, nine years respectively plus two whipping for each jail sentence.
The total whipping for additional sentences were 10 strokes.
The accused was also ordered to attend counselling for a total of 10 years and to be referred to the Immigration Department after completing his jail sentences for further action.

The court heard that the man committed the sexual physical assaults against the 16-year-old on five occasions at a house in Manggatal between March 13 and 14, this year.

They included inserting his private part into the girl’s mouth, fondling her breasts, asking her to hold his private part and inserting his finger into the girl’s private part.
The offences under Section 14(a) and 14(d) of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years, and whipping, on conviction.
The man received the additional punishment under Section 16(1) of the same Act carries a jail term of up to five years, and whipping at least two strokes, on conviction.
The incidents happened when the victim’s mother was not at home. Soon as she reached home, the mother was surprised to see the victim in fear with eyes swollen due to crying over her ordeal.
The mother had married the man and had three children. The victim was one of two children from her previous marriage.
