Foreigner gets jail, rotan for sodomising boy, 12

Kota Kinabalu: A 20-year-old foreigner was jailed 10 years and ordered to be caned once by the Sessions Court, here, Monday, for sodomising a 12-year-old boy three months ago.Mohd Raffie Salim pleaded guilty before Judge Azreena Aziz to committing the crime against the boy at the staircase of an apartment in Penampang between 7pm and 8pm on Feb 2, this year.

The offence under Section 377A of the Penal Code carries a jail term of up to 20 years and whippings on conviction.
Raffie was also handed four months jail for staying in the State illegally under Section 6(1)(c) of the Immigration Act.
Deputy Public Prosecutor Afiqah Alya AK Johari PG Johari, prosecuting, informed the court that the boy had complained to a relative at 7.30pm on Feb 4 that he had pain in the anus and narrated the incident.
The court heard that investigations revealed that prior to the incident, the victim went to a prayer hut in the village with his cousin for Maghrib prayer and while waiting outside the hut, a man later identified as Raffie, asked them to bring him to a man’s house.

When reaching an apartment, Raffie asked the victim’s cousin to wait and entered a lift with the victim.
Raffie then took the victim to the stairs and assaulted him before sodomising him.

The prosecution said the victim was referred to the hospital for further observation following a police report lodged by his relative and that Raffie was arrested by police two days later on Feb 6.
Unrepresented, Raffie requested for leniency. However, the prosecution applied for a heavier sentence as the boy was traumatised by the incident.
The court ordered Raffie to serve the sentence for illegal entry from the date of his arrest and ordered to be referred to the Immigration Department thereafter.
The court also ordered Raffie’s jail term for sodomy to run concurrently with the first count’s sentence.
