Bribes: Man jailed, fined RM40,000

Kota Kinabalu: A 32-year-old man was sent to prison for two-days and fined RM40,000 in default 12 months’ jail for accepting bribes of RM4,300.Syarafi Syahir Kasah pleaded guilty before Sessions Court Judge Jason Juga to four charges against him on Tuesday.

The court imposed two days’ jail and a RM10,000 fine or spend three months in prison for each charge and the jail sentence to be served concurrently from Tuesday.
On the first to fourth counts, Syarafi had received the bribes ranging between RM700 and RM1,500 from a man in return for obtaining CIDB (Construction Industry Development Board) certificates and related contractor certificates for the man’s company.
The offences took place at the Maybank branch in Sipitang, between July 24, 2020 and Nov 10, 2020.
The offence under Section 16(a)(A) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, punishable under Section 24(1) of the same act carries a jail term of up to 20 years, and a fine of no less than five times the amount of bribe received, or RM10,000, whichever amount is higher, on conviction.

In asking for leniency, Syarafi told the court that he was a divorcee who needs to support his two young children.
He added that it was his first offence and was remorseful of his action.

Deputy Public Prosecutor Nurul Izzati Sapifee from the MACC urged a reasonable term of jail to be imposed against Syarafi.
