Road bully jailed and fined: Magistrate Court

The complainant, who was driving to the city with his wife and seven-month-old baby to have dinner, alighted from his vehicle while Norris also got out of his car with a hammer and strangled the complainant’s neck and tried to hit Nulsalim who managed to avoid the blow but it hit the windscreen, causing it to break.
Kota Kinabalu: A van driver was jailed a week and fined RM1,500 or another two months on Monday for assaulting a man during a road incident.
Norris Peritos, 34, pleaded guilty before Magistrate Jessica Ombou Kakayun to voluntarily causing hurt to Nulsalim Kelana, 28, at 9.15pm on May 19, at the Bandaran roundabout in front of the Shell Plaza here.
ADVERTISEMENT The charge under Section 323 of the Penal Code carries a jail term of up to one year or fine of up to RM2,000 or both, on conviction.
Prosecuting officer Insp Mohammad Khairul Nizam Mokhtar told the court that prior to the incident, Norris was not satisfied with the way the complainant was driving because he blocked his path.
Norris then followed closely behind the complainant’s vehicle and blocked his vehicle by stopping on the shoulder of the road.

When asked by the Magistrate why he committed the offence, Norris claimed he was agitated by the traffic jam in the city but that the feeling disappeared after being held in lockup.

He added that he left the scene immediately after realising that there was a baby inside the complainant’s vehicle.
Norris, who was not represented, requested leniency while the prosecution applied for an adequate sentence.
The magistrate ordered the jail sentence to run from the date of his arrest on May 19.
Meanwhile, a 30-year-old man was charged with assaulting a man with a flower pot.
Jeviron Moringding pleaded not guilty to committing the offence to Charles Peter at 2.30am on May 9, this year outside the Lite and Easy Café in Penampang.
The charge is framed under Section 324 of the Penal Code carries jail a jail term of up to 10 years or fine or whipping, on conviction.
The prosecution proposed bail at RM5,000 while counsel Sylvester Kuan, representing Jeviron, applied for a lower bail amount.
The court set June 30 for case management and released the accused on a bail of RM1,800 in two sureties and to report to the investigating officer once in two weeks.
