KOTA KINABALU: Three former secondary school students won in their civil suit against a teacher, a then school principal, the Education Minister and two others for refusing to teach the English Language subject to the students six years ago.

High Court Judge Leonard David Shim found, on Tuesday, that the plaintiffs have proven their case on a balance of probabilities.
The decision was for the plaintiffs – three former students of SMK Taun Gusi, Kota Belud, namely, Rusiah Sabdarin, Nur Natasha Allisya Hamali and Calvina Angayung, all 22.

The court had allowed the plaintiffs’ claim.

The court made no order as to costs as this case involved the fundamental constitutional right to education and matters of public interest.
Nominal damages in the sum of RM30,000 are to be paid to each of the plaintiffs by the first, second, third, fourth and fifth defendants jointly and severally.
