Kota Kinabalu: An unemployed paperless Filipino was jailed a year, Friday, for assaulting his wife with a spade.
Jerald Ali Basari, 29, pleaded guilty before Magistrate Lovely Natasha Charles to voluntarily causing hurt to his wife with the spade at 3am on July 31 in a house at Kg Bandulan, Jalan Sepanggar, near here.

Inspector Kelvan Elson Maik told the court that the victim’s mother lodged a police report at 4.06pm the same day stating that Jerald came to her house with a spade and hit her daughter.
The court heard that Jerald frequently beat his wife but no police report was lodged and that the victim was scared of Jerald and ran away to stay with her mother.
During the incident, the wife was sleeping in a room before being hit by Jerald, said the prosecution, adding that the wife and the complainant managed to escape to a neighbour’s house.

Jerald, who then ran amok outside the house, was arrested by the police.
Jerald was also tested positive for syabu, the court heard.

The injured victim was treated at the hospital, said the prosecution, adding that the reason the couple with two children fought because Jerald was not working and always asked for money to buy drugs.
Unrepresented, Jerald requested a lenient sentence and claimed that he did not want to hit his wife but just wanted to hit the wall, adding that he was angry because his mother-in-law did not allow him to live in the house.
Kelvan applied for a deterrent sentence.
The court ordered Jerald to serve the sentence from the date of his arrest and granted the prosecution’s application for him to be referred to the Immigration Department after that.
Meanwhile, a man was fined RM1,500 or five months jail for keeping stolen vape equipment.
Aniq Khairulanwar, 27, admitted to keeping a bottle of vape, a vape unit, battery charger and a bag of vape equipment belonging to Nasthasia Azura at 4.45pm on Aug 29 in a house at Kg Indai, in Tuaran.
The court heard from the prosecution that the equipment was stolen from the complainant’s shop in Penampang on Aug 22.
Aniq was charged under Section 411 of the Penal Code which carries a jail term of up to five years or fine or both, on conviction.
In another case, four people were jailed for having syabu.
Rahman Jinin, Nomer Eder, Muhadir Muhedin and Mohd Afazi pleaded guilty to having syabu weighing between 0.03gm and 0.38gm at separate locations in Likas and Inanam between Jan 30 and June 6.
Rahman was handed 11 months jail while the rest received 10 months jail each.
They were charged under Section 12 (2) of the Dangerous Drug Act 1952 which provides for a fine of up to RM100,000 or up to five years jail or both, on conviction.
