Man, 27, gets 9 years, rotan for raping 15-yr-old lover
He committed the offence under Section 376(1) of the Penal Code, which provides for a jail term of up to 20 years and whipping, on conviction.
Kota Kinabalu: A 27-year-old man was jailed nine years and ordered to receive a stroke of the cane by the Sessions Court, Wednesday, for raping his underage girlfriend which resulted in the birth of a baby four years ago.

Mohd Seharul Mohd Mubin pleaded guilty before Sessions Court Judge Noor Hafizah Mohd Salim to raping the 15-year-old girl on Aug 2022 in a rental room at Inanam Business Centre, here.

He committed the offence under Section 376(1) of the Penal Code, which provides for a jail term of up to 20 years and whipping, on conviction.

The court was informed by the prosecution that Seharul and the girl had sex several times.

The girl gave birth on May 13, this year and the DNA report confirmed that Seharul was the biological father, said the prosecution.

In applying for leniency, Seharul, who was not represented, said he was remorseful.

However, Deputy Public Prosecutor (DPP) Afiqah Alya urged the court to impose a deterrent sentence as it was a serious offence and sexual cases involving minors were rampant.

In another court, a 62-year-old man was jailed three months by the Magistrate Court for trespassing.

Yusri Awang pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to committing the offence at Block C in Surian Perdana, here, at 12.15pm on May 12, 2024.

The offence, under Section 447 of the Penal Code, carries a jail term of up to six months or fine of up to RM3,000, or both, on conviction.

The court heard from the prosecution that on the said day, the security team arrested Yusri after he was seen on CCTV footage trying to steal a motor water pump and damage the transformer.

Duty counsel Carmen Khoo, representing Yusri, requested a lenient sentence as he is divorcee.

DPP Ling Ghuog Zin, prosecuting, applied for an appropriate sentence.

Yusri was told to serve the sentence from the date of his arrest.
