Man charged with assaulting pregnant wife
He was charged under Section 323 of the Penal Code read together with Section 326A of the same Code.
Kota Kinabalu: A shop assistant was charged in the Magistrate’s Court here Tuesday with assaulting his pregnant wife.

Ag Zulfadhli Ag Mohd Ali, 31, who appeared before Magistrate Lovely Natasha Charles, pleaded not guilty to the charge against him.

He was accused of voluntarily causing hurt to his wife at 12.01am on May 23, this year, at a house in Kg Tanjung Aru lama here.

He was charged under Section 323 of the Penal Code read together with Section 326A of the same Code.

Section 323 carries a jail term of up to one year or a fine of up to RM2,000 or both on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable for conviction for the offence.

Inspector Kelvan Elson Maik, prosecuting, in applying for a pre-trial case management (ptcm), proposed bail at RM3,000.

The court fixed July 2 for ptcm and released the accused on a bail of RM2,000 in two sureties.

In another case, a 39-year-old man was sentenced to three years jail and ordered to be caned three times for having 12.73gm of syabu.

Julhari Allus admitted to having the syabu on at noon Oct 4, 2023, in Sepanggar.

He was charged under Section 12(2) of the Dangerous Drugs Act and punishable under Section 39A(1) of the same Act which carries a jail term of between two years and five years and whipping between three and nine strokes, on conviction.
