Kota Kinabalu: A 32-year-old man claimed trial in the High Court here to trafficking 318.9gm of syabu.
Elsan Hassan was brought before Judicial Commissioner Maslinda @ Linda Mohd Ainal for committing the offence at 10.30pm, on Feb 11, this year, at Lorong Dua, at the roadside of Jalan Datuk Haji Jumat Haji Idris, Kg Cenderamata, Likas.
The charge under Section 39B(1)(a) of the Dangerous Drugs Act (DDA) 1952, carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes.
Maslinda set July 10 for pre-trial case management and ordered the accused to be remanded further as the charge against him has no provision for bail.
Deputy Public Prosecutor Rustam Sanip prosecuted while Elsan was represented by counsel Shahlan Jufri and Mohd Luqman Syazwan.
Meanwhile, an e-hailing car driver was charged in the Magistrate’s Court with two counts of drug trafficking.
No plea was recorded from Victor Chin, who appeared before Magistrate Stephanie Sherron Abbie, after the charges were read out to him.
Chin, on the first count, allegedly trafficked 188.11gm of 3,4 -Methylenedioxymethamphetamine (MDMA) at 11.30pm on May 27, this year, at the parking lot of Block K, Beverly Hill Apartment, Phase 3, in Penampang.
On the second count, Chin was accused of trafficking 5,780.58gm of 3,4-Methylenedioxymethamphetamine (MDMA) at 11.45pm on May 27, this year, in a unit at Block K, of the same apartment.
Prosecuting Officer Inspector Suzie S.K. in applying for a mention date objected bail as the charge has no provision for bail.
Stephanie fixed Aug 7 for mention pending the chemist’s reports and ordered the accused to remain in custody.
The accused was represented by counsel Luke Ressa Balang.
