Kota Kinabalu: The Federal Court commuted the death sentence of a Filipino to life for trafficking syabu.
Timhar Jimdani Ong, 56, managed to get life imprisonment after the three-member bench comprising Justices Tan Sri Amar Abang Iskandar Abang Hashim, Datuk Nordin Hassan and Datuk Abu Bakar Jais allowed the application to review the death sentence against him under the Revision of Sentence of Death and Imprisonment for Natural Life Temporary Jurisdiction of the Federal Court) Act.
Justice Amar set aside the death sentence imposed on Timhar and substituted it with life imprisonment of 30 years from the date of his arrest on Aug 11, 2005.
On Apr 27, 2009, the High Court sentenced Timhar to death after finding him guilty of trafficking 336.66gm of syabu at 10.50am on Aug 11, 2005 at a room of a hotel in Jalan Gaya, here.
He lost his appeals at the Court of Appeal and at the Federal Court.
In another review application, a 45-year-old Filipino got 35 years’ jail after his death sentence had been set aside, for killing another man.

The panel allowed Al Sarip Ambong’s review application against the death sentence.
Al Sarip was on May 12, 2014 sentenced to death after the court found him guilty of murdering Muslim Samma, 30, at 9.30am on Nov 8, 2011 at a house in Kg Hidayat Jalan Apas, Tawau.
He lost both his appeals against the death sentence at the Court of Appeal and Federal Court.
Assigned counsel Hamid Ismail defended the duo.
