Lim had posted the abusive words through his Facebook page – Lim Lim – on Oct 15, 2023 in which the post was read by Phan Chee Yong at a house here.
The post was made with the intention of hurting others’ feelings.
The offence, under Section 233(1)(a) of the Multimedia and Communication Act 1998, carries a fine of up to RM50,000, or a jail term of up to a year, or both, on conviction.
As Sabah Basketball Association President, Phan felt ashamed and the action by Lim had tarnished his good name and dignity.
Further investigation revealed that Lim had used his handphone to post the comments on Facebook.
Deputy Public Prosecutor Muhammad Azizi Hamil appeared for the prosecution while Lim was not represented.
