Fined for assaulting ex-wife
Herman was charged under Section 323 of the Penal Code which carries a jail term of up to one year or fine of up to RM2,000 or both, on conviction.
Kota Kinabalu: A receptionist who assaulted his former wife last month was on Thursday fined RM1,000 or a month’s jail by the Magistrate’s Court here.

Herman Idris, 42, pleaded guilty to voluntarily causing hurt to his ex-wife, 34, on June 20, at 8pm, in a unit of a condominium, in Putatan.

Magistrate Lovely Natasha Charles was informed by the prosecution that prior to the incident, a heated argument ensued between the two, stemming from the complainant voicing an issue about another woman to Herman.

Herman became angry and pushed the complainant until she fell onto the mattress in the bedroom before he grabbed her handphone from her.

The complainant got up and followed Herman to the living room as she wanted to retrieve her phone.

During the struggle to retrieve the mobile phone, Herman punched the complainant once in the chest, after which she took their two sons out of the house.

Herman prevented the complainant from opening the door by pulling her hand.

Due to Herman’s actions, the complainant experienced pain in her chest and left hand, said the prosecution.

Duty counsel Carmen Khoo, representing Herman, requested a lenient sentence, citing that he is a divorcee with two sons, works as a receptionist and takes care of his mother and younger brother.

It was Herman’s first offence, added Khoo.

Inspector Kelvan Elson Maik, prosecuting, applied for an appropriate sentence.

Herman was charged under Section 323 of the Penal Code which carries a jail term of up to one year or fine of up to RM2,000 or both, on conviction.

In another similar case, a Korean national  was given a discharge not amounting to an acquittal (DNAA) from a charge of assaulting a woman.

The magistrate released Bak Hak Ki, whose case came up for case management, after being informed by the complainant that she had lodged a police report to withdraw her previous report against the accused.

The prosecution applied for another mention date pending an instruction from the Deputy Public Prosecutor’s office.

Bak, 63, was accused of causing hurt to Wan Nur Zulaiqa Wan Azhar at 11.80pm, at 7-Eleven premises in Lintas here.

On June 12, this year, Bak claimed trial to the charge under Section 323 of the Penal Code.
