Kota Kinabalu: A 27-year-old man was jailed six years and ordered to get two strokes of the cane for taking syabu repeatedly.
Sessions Court Judge Noor Hafizah Mohd Salim meted out the sentence to Elvin Andreen after ruling that the prosecution had proven it’s case beyond reasonable doubt.
Elvin was found guilty of taking the drug on Nov 12, 2021 at 1pm after his urine was tested positive at the Beaufort police station.
He has two previous conviction records for taking drugs.
The offence under Section 39C (1) of the Dangerous Drugs Act 1952 provides for a jail term of between five and seven years, and whipping, on conviction.
The court allowed ordered him to be placed under police supervision for three years after completing the jail sentence.
Eight prosecution and two defence witnesses were called during the trial.

Pending the appeal, Elvin was released on bail and ordered to report to the police station twice a month.
