Justine Ongkomog @ Amran Mohd Osman, pleaded guilty before Sessions Court Judge Jason Juga, to five alternative charges against him on Tuesday.
Jason imposed the sentence on Justine on the fourth and fifth counts while on the first to third counts, the court allowed the prosecution’s application to use the Take into Consideration (TIC) for the charges.
The prosecution had applied the TIC to be used on the first to third counts under Section 171A of the Criminal Procedure of Code.
On the first to third counts, Justine was accused of using three fake documents which had been submitted to the Assistant Collector Land Revenue, Keningau to deceive for the purpose of getting compensation payments for the land area involved in upgrading the Sook-Tulid-Sinua-Sinua, Keningau road project (Phase 2).
On the fourth and fifth counts, Justine who is a blind, was fined RM7,000 or three months’ jail for each charge.
On the fourth and fifth counts, Justine had used the two fake documents which had been submitted to the Assistant Collector Land Revenue, Keningau to deceive for the purpose of getting payment for his claims.
The offence took place at the Collector Land Revenue office in Keningau on June 4, 2014.
The offence under Section 471/465 of the Penal Code carries a jail term of up to two years, or jail, or both, on conviction.
Earlier, Justine claimed trial to the five main charges but since he admitted to the alternative charges, the main charges under Section 18 of the Malaysian Anti-Corruption Commission (MACC) Act, were withdrawn.
Justine paid the fine.
During mitigation, Justine who was accompanied by his relative to enter the accused dock, applied for leniency saying that he is blind and his wife is suffering from cancer.
He also told the court that he was working but on leave due to health reason.
Justine added that he needed to look after his five children and his disabled mother-in law.
MACC Prosecuting Officer Norsham Saharom urged the court to impose an appropriate sentence on Justine.
