Kota Kinabalu: A 51-year-old gardener, who threatened to murder a lawyer, was on Tuesday fined RM2,000 or jailed six months by the Magistrate’s Court here.
Sazali Diman pleaded guilty before Magistrate Stephanie Sherron Abbie to committing the offence against Erveana Ansari Ali by threatening to cause death to her on
May 17, this year, at 10.40am, at a house in Kg Tengah Petagas, Putatan.
Sazali changed his plea to guilty to the charge on Tuesday, which was scheduled for a review of an arrest warrant issued against him for not being present in court during the previous mention of his case.
He had on May 27, claimed trial to the charge under Section 506 of the Penal Code, which carries a jail term of up to seven years or a fine or both, on conviction.
He was then released on court bail pending pre-trial case management on June 27.
The facts of the case presented by the prosecution revealed that on the said day prior to the incident, the complainant, along with the court bailiff and a police team, visited the house to evict the occupants because the period given by the court to vacate the house had already expired on May 17, this year.
However, the resident of the house, identified as Sazali, threatened the complainant by saying: “Saya bunuh kau, kau tunggu sana, saya bunuh tujuh keturunan kau (I will kill you, just wait there, I will kill seven generations of your family).”
Subsequently, the complainant lodged a police report.
Police investigations uncovered that the original owner of the land was Sazali’s father, who had sold both the land and the house on the plot of land to a woman buyer on December 15, 2022.
Sazali felt discontented with being compelled to vacate the house and the land, the facts stated.
Pleading for leniency, Sazali requested a lenient sentence as he is currently renting a house and was remorseful.
Inspector Suzie SK applied an appropriate sentence.
Meanwhile, a cashier of a bakery shop was charged with stealing from her workplace.
Sitti Nurshilla Fitriani Abdullah, 22, pleaded not guilty to stealing RM150 cash belonging her employer, Authentic Garner Confectionery (M) Sdn Bhd, on July 9, this year, at Mr Bread, Kingfisher Plaza here.
The charge under Section 381 of the Penal Code carries a jail term of up to seven years and liability of a fine, on conviction.
The court set Aug 28 for pre-trial case management and released her on a bail of RM1,800 in two sureties.
