Murder: 13 vocational college students’ case goes to High Court

LAHAD DATU: The Magistrate’s Court on Thursday ordered the case of 13 vocational college students charged with the murder of a 17-year-old student to be transferred to the Tawau High Court.
Magistrate Nur Asyraf Zolhani made the decision she allowed the application by Deputy Public Prosecutor Ng Juhn Tao under Section 177A(1) of the Criminal Procedure Code.
ADVERTISEMENT However, no date was set for mention at the High Court.
The 13 accused, aged 16 to 19, were jointly charged with murdering Mohammad Nazmie Aizzat Mohd Narul Azwan at Bilik Asrama 7 Resak and 5 Belian, Lahad Datu Vocational College, between 9pm on March 21 and 7.38am the following day.
The charge was framed under Section 302 of the Penal Code, read together with Section 34 of the same law.
Nine of the 13 students were represented by lawyers Datuk Ram Singh, Kamarudin Mohamad Chinki, Chen Wen Jye and Amirul Amin Rashid.
ADVERTISEMENT Another teenager was represented by lawyer Abdul Gani Zelika while the other three were not represented.
Meanwhile, Kamarudin Mohamad Chinki when met outside the court said the prosecution obtained permission from the Attorney General’s Office to transfer the case to the High Court in Tawau.

“In addition, we also applied at the request of the parents that these teenagers be remanded at the Lahad Datu prison, to facilitate visitations,” he added.
On March 22, Mohamad Nazmie Aizzat was found dead with injuries and bruises at the college dormitory.
Following that, the 13 students were arrested and subsequently remanded.
