 Attorney-General’s last-minute statement regretted, says Warisan

KOTA KINABALU: The Federal Attorney-General’s decision to continue challenging the judicial review filed by Sabah Law Society (SLS) at the Federal Court on July 16 and made known to the public only on July 24 is regrettable, said Sipitang Warisan Information Chief Yusri Pungut. 

Yusri, also a lawyer, claimed Warisan was the first party to openly support SLS. 

"The GRS-led State Government only did so after its former counsel ‘made several blunders’ during the hearing at the Court of Appeal on May 16, this year.” 

“On May 25, this year, Sabah PH supported the State Government's decision to drop the challenge against SLS and further stated that it will ensure the matter be resolved through the Implementation Action Council and Technical Committee (MA63 Committees) headed by the Prime Minister and the Second Deputy Prime Minister respectively,” he said. 

“Interestingly, when Sabah PH dropped their originating summons against both the Federal and State Governments on Sept 19, 2023, media reported that their reason for doing so was the formation of the Malaysia Agreement 1963 Implementation Action Council (MTPMA63), chaired by the Prime Minister, and a technical committee for MTPM63 (Technical Committee), chaired by the second Deputy Prime Minister. 

“Sabah PH referred MTPMA63 to justify their actions in both instances.” 

However, he said, a year had gone by, and except for the non-compliance of its July 18 deadline and subsequent ball passing, MTPMA63 had not achieved anything significant regarding the settlement of the 40 per cent entitlement. 

“With this fresh challenge being filed by the Federal AGC at the Federal Court, will Sabah PH now collectively and openly support SLS or continue to say that MTPMA63 is the right platform for the settlement of 40 per cent even after a year-long delay with the continuous ball passing? 

“If Sabah PH supports SLS, it will surely persuade the Prime Minister to instruct the Federal AGC to retract the fresh challenge filed at the Federal Court. 

“And if Sabah PH is unable to assert or free itself from the political clutches of its masters, then it should support the call by Warisan to establish the Permanent Parliamentary Special Select Committee (PSC) for MA63 (including the settlement of the long-awaited 40 per cent) entitlement),” he said.
