Kota Kinabalu: A 28-year-old man was jailed three years and ordered given two lashes of the cane on Wednesday for cheating a woman over a car swap deal two years ago.
Muhammad Suhaimie Maklin pleaded guilty before Magistrate Lovely Natasha Charles to cheating Farhana Maisarah by tricking her into exchanging her Perodua Kelisa car for a Honda City and fraudulently inducing her to hand over the Kelisa along with RM7,000 cash.

The offence took place on July 23, 2022 between 7pm and 11.30pm at a restaurant in Kg Warisan, Kalansanan, Inanam.
Deputy Public Prosecutor (DPP) Muhammad Al-Hakim Abdul Razak informed the court that on July 23, the complainant and her husband handed over a Perodua Kelisa worth RM20,000 and RM7,000 cash to Suhaimie to exchange the car by ‘sambung bayar’ (continue installments)’ with a Honda City car.
After two months of using the Honda City, the complainant and her husband were approached by a man, who claimed to be the owner of the Honda City who said he had rented the car to Suhaimie but had not received any rental payments.
The complainant contacted Suhaimie and requested the return of her car along with the RM7,000

However, by the time the police report was lodged, Suhaimie could not be located, the court heard.
The complainant also discovered that her Kelisa had been sold, said the prosecution.

Suhaimie requested a minimal sentence and is currently serving a sentence of two years and three months for an offence under Section 403 of the Penal Code.
DPP Al-Hakim applied an adequate sentence as a lesson to Suhaimie.
The prosecution submitted that Suhaimie’s actions had caused the complainant to incur RM7,000 loss and the Honda City repossessed by the owner and Suhaimie had also sold the complainant’s Kelisa.
In another case, a 27-year-old woman was fined RM2,000 or two months jail for engaging in an online gambling activity with a handphone.
Siti Hasnah Sahul admitted to committing the offence on July 23, this year at a premises in Sinsuran here.
The court heard from the prosecution that Siti was arrested by a police team after she was seen involved in the gambling activity.
The charge under Section 7(2) of the Common Gaming Houses Act provides for a fine of up to RM5,000 or up to six months jail or both, on conviction.
Duty counsel Carmen Khoo requested a lenient sentence as Siti, who is a divorcee with two children, was remorseful.
The prosecution applied for a deterrent sentence.
