Jailed for threatening to kill man with homemade air gun
The facts of the case presented by the prosecution stated that on the said day, Joenathan went berserk and pointed a homemade air gun at the complainant, uttering the threatening words, “Aku kasi mati kau !( I’m going to kill you!)”.
Kota Kinabalu: A 30-year-old man was jailed 10 months by the Magistrate’s Court on Friday for threatening to kill a man with a homemade air gun.

Electrician Joenathan Jafri pleaded guilty before Magistrate Stephanie Sherron Abbie to committing the offence against Jainal Onggai, 50, on Dec 29, 2023, at 1pm, at Kg Hubah, Penampang.

The charge under Section 506 of the Penal Code carries a jail term of up to seven years or a fine or both, on conviction.

The facts of the case presented by the prosecution stated that on the said day, Joenathan went berserk and pointed a homemade air gun at the complainant, uttering the threatening words, “Aku kasi mati kau !( I’m going to kill you!)”.

The incident occurred after the complainant reprimanded Joenathan for damaging the left and right side mirrors of a car and the door of the complainant’s house, resulting in a loss of RM537.16.

The complainant, fearing for his safety and that of his family’s, lodged a police report.

Duty Counsel Lim Ming Zoong @ Lawrence, representing Joenathan, requested a lenient sentence as Joenathan, who is married with two children,  was the sole breadwinner of his family and has no previous conviction record.

The prosecution applied for an adequate sentence.

In another case, two men were penalised for fraudulently having cash in their respective bank accounts.

Ong Choon Fatt, 38, was fined RM100 or three weeks jail by Magistrate Lovely Natasha Charles for having RM1,500 in his bank account, which belonged to  Anna Andrea, on Oct 18, 2023.

Mohd Bahrin Affendi, 31, was fined RM100 or a day’s jail after he admitted before Magistrate Stephanie to having RM2,200 belonging to  Fred F. Sianggol, on Sept 29, 2023.

Ong and Bahrain failed to give a satisfactory explanation as to how they obtained the money.

The offence under Section 22A (1) of the Minor Offences Ordinance, provides a fine of RM100 or up to three months jail or both, on conviction.

Inspectors Suzie S.K. and Kelvan Elson Maik prosecuted.
