Herman is accused of committing the offence against the minor by touching her private part between 6am and 8am on April 2 this year at a house in Papar.
The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years, and whipping, on conviction.
The prosecution asked for a new mention date and the investigating officer informed that the complainant in the case had lodged a police report to withdraw the charge against Herman.
Herman, who was not represented, asked for bail to be granted.
The court set Sept 26 for mention and released Herman on a bail of RM5,000 in two local sureties.
