TAWAU: Two foreigners were jailed eight months each for having 2,250 litres of petrol without any permit.
Nadzmer Abd Hamid, 29, who hold an IMM13P document, and Isa Sabi, 45, pleaded guilty separately before Sessions Court Judge Ahmad Faizadh Yahaya.
The duo committed the offence at 9.30am on Dec 30, 2025 at the waters in Kg Tanjung Baru, Pulau Bum-Bum, Semporna.
The court ordered the duo to serve the jail sentences from the date of their arrest and to be referred to the Immigration Department after completing their jail terms.
The court also ordered for the controlled goods in the form of 2,250 litres of petrol to be sold and the proceeds forfeited to the Government.
Meanwhile, other seized items, including a speedboat, an outboard engine and 50 litres of petrol mixed with 2T oil were forfeited to the Ministry of Domestic Trade and Cost of Living (KPDN) under Section 26(1) of the Supply Control Act 1961.
According to the case facts, Nadzmer and Isa were arrested by police from Pulau Bum-Bum police station following intelligence information and were subsequently handed over to the KPDN Semporna Branch for further action.
Both were convicted of offences under Regulation 3(1) of the Supply Control Regulations 1974 for engaging in wholesale or retail trading of controlled goods, namely 2,250 litres of petrol, without a licence or permission from the Controller of Supplies.
The prosecution was conducted by the prosecuting officer of KPDN Semporna Branch, Zulkifli Baco, while the duo were not represented.
