ACCORDING to one reason of the Sulu claim, the  Sultan of Sulu mortgaged its part of Sabah to Alfred Dent and Baron Von Overbeck in 1878.  The Sultan of Brunei sold its Brunei Territory to the same businessmen.
  • The businessmen subsequently sold their Sabah land to the British Government.
  • In the case of Sabah, the mortgage was transferred to the British. The British continued paying $5,000 yearly to the Sultan of Sulu.
  • The British under world pressure, granted Independence to Sabah for a few days before Sabah formed the Malaysian Federation.
  • For some years, the Malaysian Government paid the lease money to the “heirs” of Sultan of Sulu.

Based on these claims, the British should not have transferred its leasing rights or grant Sabah independence without first canceling the lease.

Therefore, Malaysia should not entertain the Sulu Claim, as the legal responsibility is with the British.

As such the Suluks should settle their claim with the  British Government.

Unfortunately, the lawyer facilitating the Sultan of Sulu died before the claim was filed against the British Government.

Hopefully, Malaysian Ministers and leaders will realise their mistake and just ask the court to strike out the suit against Malaysia and ask the Suluk Heirs to file against the British.
