Indo gets 20 yrs for killing wife, stepson

SANDAKAN: A 43-year-old Indonesian escaped the gallows but will spend the next 20 years in prison for causing the death of his former wife and stepson.
High Court Judge Bexter Agas Michael discharged and acquitted Bakri Rukka after ruling that the prosecution had failed to prove its case beyond reasonable doubt for the original charge of murder.

The original charge falls under Section 302 of the Penal Code which carries the death sentence, upon conviction.
However, Bakri was found guilty of committing homicide not amounting to murder of Hasura Sima and Mohd Basri Jamaluddin at 5.20pm and 5.21pm on Jan 11, 2016 at a kongsi house in Kinabatangan.
The offence under Section 304(a) of the Penal Code carries a jail term of up to 30 years, and liability to a fine, upon conviction.
The court ruled that Bakri had no intention to kill the victims.

The court ordered Bakri to serve the jail sentence from the date of his arrest.
In the same court, another Indonesian was freed from a charge of murdering his fellow countryman, without his defence being called.

Ignasius Subun, 30, was discharged and acquitted after ruling that the prosecution had failed to establish a prima facie case.Stay up-to-date by following Daily Express’s Telegram channel.

Ignasius was accused of killing Yohanes Nino, 31, at 7.50am on Oct 12, 2016 at Blok 58, Plot 15, Division 4, Segampa, Ladang Genting, Jambongan, Beluran.
Deputy Public Prosecutor Franklin Ganggan Bennet conducted the prosecution while Farazwin Haxdy defended Bakri and Ignasius.
