Bosses may have to pay RM10,000 per worker

RANAU: The Labour Department of Sabah (JTKS) urged employers to comply with the Minimum Wage Order (Amendment) 2018 or face legal action.

Public Relation Officer Xavier JP Yuntavid said if employers fail to comply, they can be fined up to RM10,000 per employee and the court may order the employer to make an understated payment to the affected employee.

“A two-day operation was held around Ranau and Kundasang led by Enforcement Division Headquarters involving 50 enforcement officers from JTK, 20 from EPF and 50 from Socso.

“The operation successfully checked 98 employers’ premises in service sector, retail outlets and homestays,” he said.

According to Xavier, JTKS is committed to ensuring compliance with the Government order as well as with the Labour Ordinance, hence, the operation is s one of the department’s KPI.

“In addition, the operation is also eyeing compliance to Employees’ Social Security Act 1969, Employees’ Social Security (General) Regulations 1971 and Employment Insurance System Act 2017 enforced by Socso and compliance with the EPF Act 1991,” he said.

The collaboration between the three agencies allows shared information and non-compliant employers to be tracked.

Xavier said violations against the National Salary Consultative Council Act 2011 and Labour Ordinance (Sabah Chapter 67) were still found.

“Minimum wage rates are not paid and salary slips not provided by the employer,” he said, adding 38 compliance notices were issued and seven investigation papers opened for various offences.

JTK, EPF and Socso urged employees to come forward if their employers do not comply with the law.
