Four get five years for  repeat syabu offence
KOTA KINABALU: Four men were sentenced to five years’ jail and ordered given a stroke of the cane each for repeat offence in taking syabu, respectively.

They were Azmi Alitar, David Gregory Duil, Wan Farrid Ag Tahir and Nordin Abdullah.

The four pleaded guilty separately before Sessions Court Judge Azreena Aziz to taking the drug for the third time.

They were found taking the drug between Aug 19 and 28 this year after their urine samples were tested positive for drug at the different police station.

The court heard that they have two previous convictions for taking the drug.

The offence under Section 15(1)(a)/39C(1)(b) of the Dangerous Drugs Act 1952 provides for a jail term of between five and seven years, and whipping at least three strokes, on conviction.

The court ordered the four to serve the jail sentence from the date of their arrests.

After completing their jail sentences, the four were ordered placed under police supervision for two years.

All of them asked for the sentence to be served in Labuan prison.

Deputy Public Prosecutor Siti Amirah Muhammad Ali appeared for the prosecution.

In another case, a 50-year-old Pakistani was jailed four months for overstaying in the State.

Shah Zaman Khan admitted to staying in the State after his passport had expired on Dec 6, 2018. The court ordered Shah to be referred to the Immigration Department after serving his jail sentence.
