Woman fined RM12,000 for having cooking oil without permit

The offence under Section 21 of the Supply Control Act 1961 and punishable under Section 22(1) of the same Act carries a fine of up to RM17 million, or a jail term of up to three years, or both, on conviction.
Kota Kinabalu: A woman was fined RM12,000 in default six months’ jail for having 1,700kg of cooking oil without a licence.
Hermalin Abdullah pleaded guilty before Sessions Court Judge Elsie Primus to the charge, Monday.

The court also ordered the money from sales of the cooking oil amounting to RM3,192.30 and the bond of RM5,000 to be forfeited as government revenue while the vehicle seized be returned to the rightful owner.
Hermalin was found having the controlled goods without any permit inside a lorry at 9.40am on Sept 10, 2022 in front of a house in Taman Friendly Garden 3A, Kudat.

During mitigation, Hermalin, who was not represented, asked for a light sentence saying that she had already got the licence to sell cooking oil.

However, Prosecuting Officer Thomas Chua from the Ministry of Domestic Trade and Cost of Living (KPDN), urged the court to impose an appropriate sentence.
The court heard that based on an information, a team from the Kudat Marine police inspected the lorry parked in front of the house which was believed used to keep the control goods illegally.

Upon checking the lorry, the team found 1,700kg of cooking oil.
The team seized the cooking oil together with the lorry.
A the cooking oil was considered a perishable item, the investigation officer disposed it by selling them and the proceeds of RM3,192.30 were kept in a government trust until the case is resolved.
