Ex-teacher gets 15 years, cane for sexual assault against boy

Kota Kinabalu: A 43-year-old former teacher, who committed physical sexual assault against a 12-year-old boy four years ago, was jailed a total of 15 years and ordered two lashes of the cane by the Sessions Court here.

Judge Azreena Aziz meted out the sentence to the man on Thursday which set for the facts and sentencing.

The man had on Feb 10, this year pleaded guilty to committing the offence by performing oral sex on the boy (now 16) at 6.30pm on May 28, 2017 in a quarters of a school in Sipitang.

He was charged under Section 14 (a) of the Sexual Offences against Children Act 2017 read with Section 16(1) of the same Act as he was in a relationship of trust with the child.

The former teacher was sentenced to 13 years’ jail for the physical sexual assault offence and was handed another two years’ jail and ordered to be caned twice for the Section 16(1) offence.

Azreena ordered the imprisonment sentence to run consecutively from the date of his arrest on Feb 9, this year and ordered him to be placed under police supervision for two years after serving the sentence.

Earlier, in presenting the facts of the case, Deputy Public Prosecutor Siti Amirah Muhammad Ali, told the court that the man and the victim were playing video games in his (the former teacher) bedroom in the quarters unit before the man committed the offence on the victim.

The victim accompanied by his parents then lodged a police report against the man regarding the incident, said DPP Siti Amirah.

Investigations revealed that the man, at that time, was a teacher of a primary school in the said district and that the victim know him as a teacher who taught him to play football, the court heard.

The man, who was not represented, requested for a lenient sentence saying that he was remorseful and had repented of his action adding that he wanted to take care of his mother.

DPP Siti Amirah applied for a deterrent sentence on the grounds that the former teacher had committed a serious crime and that their relationship at that time was as a teacher and student.

The court was also informed that the man had been sacked on April 29, 2019.

Being the teacher at that time, the man had been given responsibility and trust by all parents to guide their children and being set as a good example to the pupils but he had betrayed the trust by committing the offence, the prosecution said.

Section 14(a) of the Act carries a jail term of up to 20 years and liability of a fine on conviction, while Section 16(1) of the same Act, provides for a jail term of up to five years and whipping of not less than two strokes of the cane, if convicted.
