Unlawful possession of petrol: Two foreigners fined
It is also an offence under Section 21 of the Supply Control Act 1961 and punishable under Section 22 (1) of the same Act and read together with Section 34 of the Penal Code.
SANDAKAN: The Sessions Court here Tuesday imposed a fine of RM10,000 or 15 months jail on two foreign men for unlawful possession of wholesale or retail petrol oil.

Judge Zaini Fishir @ Fisal imposed the sentence on Jefferson Hayat, 41, (no identification document) and Mubin Rahman, 30, a Filipino with an IMM13 document, after they admitted to committing the offence.

They were accused under Regulation 3 (1) of the Control of Supply Regulations 1974 for unlawful possession of retail or wholesale petrol oil amounting to 240 litres and 300 litres respectively.

It is also an offence under Section 21 of the Supply Control Act 1961 and punishable under Section 22 (1) of the same Act and read together with Section 34 of the Penal Code.

Jefferson, unable to pay the fine, was sentenced to 15 months in prison, while Mubin paid his fine and be referred to the Immigration Department as he holds an IMM13 document.

The court heard that the accused were caught during a raid under Ops Tiris conducted by the Sandakan Domestic Trade and Cost of Living (KPDN) Ministry on Feb 6 at about 6.20pm at one of the petrol stations in Sandakan.

Jefferson was in possession of 240 litres of petrol in a gallon fuel tank at pump number one of the petrol station.

Mubin was found to be in possession of 300 litres of petrol in a gallon fuel tank at pump number eight of the petrol station.

Both of them were found without the licence or permission to own the controlled commodity. 

Under Section 22(1) of the Supply Control Act 1961 (Act 122), any individual convicted of an offense can be fined not more than RM1 million or imprisoned for not more than three years, or both.

The accused were also ordered to be referred to the Immigration Department after the sentence.
