Bribes: 20 years, hefty fines for Papar Health Officer
The offence under Section 23 (1) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 which is punishable under Section 24 of the same Act carries a jail term of up to 20 years, and a fine of not less than five times the amount or value of the bribe, or RM10,000, whichever is higher.
Kota Kinabalu: An Assistant Environmental Health Officer in Papar was jailed a total 20 years and fined a total RM240,670 for 20 counts of obtaining bribes through supply and service works involving a sum of RM30,793 through his own company.

Sessions Court Judge Jason Juga ordered Henry Uning, 45, to pay the fine after ruling that the prosecution had proven its case beyond reasonable doubt against Henry.

Henry was found guilty of 20 counts against him.

The court handed one year’s jail to Henry for each of the charge and ordered him to pay fine of RM10,000 each for the 15 charges while RM16,995, RM17,250, RM22,550, RM11,250 and RM22,625 for the other charges, respectively.

Henry was ordered to serve the jail sentence concurrently.

However, the court granted Henry’s application to stay execution pending appeal against the sentence to the High Court and he must file the appeal within 14 days from the conviction.

Henry was on bail pending the appeal.

On the first to 20 counts, Henry was accused of using his position to prepare financial documents by submitting a quotation of his company - Riched Enterprise — to be selected as a supplier where the company was picked to carry out supply works.

His company was the supplier for 13 food and beverage supply works for various meetings and activities and the rest was for the supply of services including minor repairs at Biau Papar Rural Clinic, printers and office supplies.

The offences allegedly took place between June 16, 2013 and March 31, 2016 at the Papar District Health Office.

MACC Prosecuting Dzulkarnain Rousan Hasbi appeared for the prosecution while counsel Edward Paul defended Henry.
