14 claim trial at the High court for being gang members

Kota Kinabalu: Fourteen individuals, including a Datuk, claimed trial at the High Court, here, Friday for being members of the organised crime group “Geng Upik”.

The 14, who were brought separately before Judge Datuk Ismail Brahim, pleaded not guilty to committing the offence, here, between 2015 and 2023.

They were Datuk Maslan Sani, 41, Fazrul Bahar, 32, Norsyafilah Pawawoi, 27, Shahlan Shah Abdul Samad, 37, Mahathir Jibarail, 49, Zulkahar Dusing, 38, Nelson Yen Yee Chung, 46, Alkan Abraham, 35, Mohd Faridzul Asmahadi, 31, Mohd Fikrie Asme, 28, Rahman Burijin, 44, Jaisalfian Jaineh @ Zaini, 45, Mohd Fauzie Rablin, 33, and Mazlan Mahmud, 41.

Maslan was accused of committing the offence between 2015 and 24 Dec 2023, Fazrul (between 2020 and Dec 24, 2023), Norsyafilah (between 2015 and July 28, 2016), Shahlan (between 2016 and Dec 24, 2023), Mahathir (between 2018 and Dec 24, 2023), Zulkahar (between 2021 and May 3, 2023), Yen (between 2023 and Dec 24, 2023).

Alkan (between 2015 and Dec 24, 2023), Faridzul (between 2020 and Dec 24, 2023), Fikrie (between 2022 and Oct 12, 2023), Rahman (between 2018 and Dec 24, 2023), Jaisalfian (between 2018 and Dec 24, 2023), Fauzie (between 2022 and Dec 24, 2023) and Mazlan (between 2018 and Dec 24, 2023).

The charge under Section 130V(1) of the Penal Code carries a jail term of between five years and 20 years on conviction.

The prosecution applied for another mention date for documents to be tendered to the defence parties.

Ismail fixed mention date on March 27 for Maslan, Fazrul, Norsyafilah and Rahman at High Court 1; April 2 for Faridzul and Fikrie at High Court 5; April 4 for Yen and Alkan at High Court 4; April 8 for Shahlan, Mahathir, Zulkahar and Jaisalfian at High Court 2; and April 17 for Fauzie and Mazlan before him.

The 14 individual’s cases were transferred to the High Court from the Sessions Court earlier in the morning.

The 14th accused, Fikrie was first brought before Sessions Court Judge Noor Hafizah Mohd Salim to have the charge read to him without his plea being taken before his case and the other 13 being transmitted to the High Court.

The prosecution informed the Sessions Court that Fikrie is currently held under custody for a drug offence at the Correctional Centre in Simpang Renggam, Johor with a detention order from Dec 8, 2023, until Dec 8, 2025.

Deputy Public Prosecutors Lina Hanini Ismail, Siti Hajar Mat Radzi and Nur Ainaa Ridzwan prosecuted.

Maslan and Fazrul were represented by counsel Chin Tek Ming, Norsyafilah was represented by counsel Michelle Usman, Shahlan by counsel Shahlan Jufri and Luke Ressa Balang, Mahathir, Alkan and Faridzul by counsel Shahlan Mohd Luqman Syazwan, Yen was represented by counsel Datuk Ram Singh and Chen Wen Jye.

Jaisalfian was represented by counsel Muhamad Amirul Amin, Fauzie and Mazlan were represented by counsel Sylyester Kuan, while Zulkahar, Rahman and Fikrie were unrepresented.

The 14 were ordered to be further remanded pending their respective mention date.
