Kota Kinabalu: Two fishermen were jailed seven months each for having 2,400 litres of petrol without a valid licence.

Almurin Muhammad, 21, and Akram Asiduh, 51, pleaded guilty separately before Sessions Court Judge Elsie Primus, to the charge against them.

They were found having the controlled goods without permit at 4.30am on May 13 this year on a pump boat in Pulau Kankamat.

The offence under Section 21 of the Supply Control Act is punishable under Section 22(1) of the same Act and read together with Section 34 of the Penal Code.

Those who committed the offence under the Section could be fined of up to RM1 million, or jailed up to three years, on conviction.

The court ordered the Filipinos to serve the jail sentence from the date of their arrest and referred to the Immigration Department after serving their sentence.

During mitigation, the duo asked for leniency.

However, the prosecution urged the court to impose a deterrent sentence.

The court ordered the proceeds of petrol which had been auctioned and boat to be forfeited to the government of Malaysia.
