Man, lover fined for concealing birth

Kota Kinabalu: A self-employed man and a 29-year-old woman were fined RM4,000 or three months jail each by the Magistrate’s Court here Friday for concealing the birth of a baby boy last month.
Mohd Aideed Husien, 30, and clerk Rabiatul Adawiyah pleaded guilty before Magistrate Stephanie Sherron Abbie to concealing the birth of the baby by secretly burying his body at THE Kg Likas cemetery, here, at 3pm, on April 13.

Both Aideed and Rabiatul, who were not represented, requested for a lenient sentence.
Aideed informed the court that he is married with five children.
Aideed claimed that the baby had died during birth.

To a question about whether Rabiatul, who stood next to him in the accused dock, was his wife, Aideed claimed that she was not his wife but a companion.
Inspector Suzie S.K. applied for a deterrent sentence as a lesson to both Aideed and Rabiatul and the public not to commit similar offence.

Earlier, the court was informed by the prosecution that a doctor at the Women and Children’s Hospital in Likas received a patient complaining of headache and dizziness.
After examination, the patient, later identified as Rabiatul, was found to have recently given birth.
Rabiatul admitted to giving birth to a baby boy on April 13 in a village in Tuaran but the baby died shortly after birth.
She also confessed to burying the body herself at the Likas cemetery with the assistance of her boyfriend, Mohd Aideed.
Police investigations revealed that Mohd Aideed confessed to helping Rabiatul during the childbirth and had taken the body to the Likas cemetery for burial.
In another case, three men were fined RM500 or a week’s jail each for assaulting another man.
Md Jamaluddin Berahim, 23, Aman Arsad, 32, and Hairul Ali, 36, pleaded guilty to voluntarily causing hurt to Ahmad Khuwarizmy at ITCC Mall in Penampang, at 5.45pm, on May 19.
The charge under Section 323 of the Penal Code carries a jail term of up to one year or fine of up to RM2,000 or both on conviction.
The court was informed by the prosecution that on the said day, Ahmad was walking with his girlfriend when they were approached by his girlfriend’s former boyfriend, Aman, and two other men.
The trio then assaulted Ahmad by kicking and punching him on his body.
The three during mitigation, requested leniency.
When questioned by the court why they assaulted the victim, Aman stated he was angry because his girlfriend was seeing someone else.
Jamaluddin said he empathised with Aman and shared his pain, while Hairul claimed he accidentally struck the victim while intending to protect his friends.
Jamaluddin and Aman were represented by duty counsel Lim Ming Zoong @ Lawrence.
